Terms of Service

These Terms explain the rules for using OGAM, including account registration, fan clubs, live streaming, 1:1 video calls, coins, gifts, VIP benefits, host activity, safety standards, and paid digital services.

If you do not agree to these Terms, please stop using OGAM and delete your account where available. Important changes will be announced through the app, website, email, push notification, or service notice.

Introduction

  1. These Terms of Service ("Terms") are a legal agreement between OrangeTour Co., Ltd. ("Company", "we", "us", or "our") and each person who accesses or uses OGAM ("user", "you", or "your").
  2. OGAM includes the mobile applications, user web service, host functions, fan club features, live streaming, 1:1 video and voice call functions, chat, paid digital items, websites, customer support channels, and related services provided by the Company (collectively, the "Service").
  3. Additional notices, operation policies, community guidelines, host rules, event rules, payment notices, and platform rules may apply to specific features. If a feature-specific notice conflicts with these Terms, the more specific notice applies to that feature unless prohibited by law.
  4. These Terms apply together with the OGAM Privacy Policy, available at privacy-policy.html.

Eligibility and Account

Age and legal capacity

  1. OGAM is available only to adults aged 20 or older. If the law of your country or region requires a higher age, the higher age requirement applies.
  2. You may not use OGAM if you are prohibited from using the Service by applicable law, by a court or administrative order, by sanctions rules, or by a previous Company restriction.
  3. You represent that the information you provide is accurate, current, and not misleading. You must promptly update account, profile, host, settlement, and contact information when it changes.

Account registration and security

  1. You may register or log in using supported methods such as Google, Apple, Firebase authentication, SMS verification, or other methods made available by the Company.
  2. You are responsible for keeping your account, device, login method, verification code, and session secure. Activity through your account may be treated as your activity unless the Company determines otherwise.
  3. You may not sell, rent, transfer, share, or allow another person to use your account without the Company's prior consent.
  4. The Company may request age, identity, phone, payment, safety, or host verification where needed to operate the Service, comply with law, prevent abuse, or protect users.

Service Description

OGAM is a real-time communication and entertainment service that helps users discover, chat with, support, and interact with hosts and other users. Features may vary by country, device, app version, operating system, account status, gender setting, host approval status, safety review, payment channel, and Company operation policy.

  1. The Company may add, modify, suspend, restrict, replace, or end any feature for security, legal, business, technical, or service improvement reasons.
  2. The Company may set limits on storage, call duration, live duration, message volume, coin use, fan club participation, gift sending, host exposure, automatic matching, and other service use.
  3. Recommendation, exposure, matching, ranking, notification, and moderation systems may use automated systems and human review to improve safety and service quality.

Device, Connectivity, and No Emergency Service

  1. You are responsible for your device, network connection, operating system, app store account, data charges, and any fees charged by your carrier or internet provider.
  2. Video calls, voice calls, live streaming, translation, and media uploads may require camera, microphone, photo, media, notification, network, or similar permissions. If permissions are denied, some features may not work.
  3. OGAM is not a telephone carrier, emergency communication service, medical service, law enforcement service, or public safety service. Do not use OGAM for emergency calls or urgent assistance.
  4. The Company is not responsible for service interruption, reduced quality, delayed calls, missed notifications, battery drain, data usage, device compatibility, or connection failures caused by your device, network, OS settings, app store, third-party services, or force majeure.

User Content

"User Content" means all text, images, profile information, photos, videos, voice, audio, live streams, chats, comments, stickers, gifts messages, fan club posts, reports, feedback, and other material that users upload, create, transmit, display, or share through OGAM.

  1. You are solely responsible for your User Content and for any consequences of uploading, sending, displaying, or sharing it.
  2. You represent that you own or have all rights needed to share your User Content and that your User Content does not violate any law, third-party right, privacy right, intellectual property right, portrait right, publicity right, contract, or these Terms.
  3. By submitting User Content to OGAM, you grant the Company a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, display, perform, transmit, translate, moderate, adapt, promote, and distribute the User Content only as reasonably needed to operate, improve, protect, promote, and provide the Service.
  4. This license ends when your User Content is deleted from the Service, except where retention is reasonably required for safety, legal compliance, backups, dispute handling, fraud prevention, payment records, moderation records, or previous lawful use.
  5. You understand that content shared in chats, fan clubs, calls, live streams, and profiles may be viewed, saved, reported, copied, or misused by other users. Do not share personal, financial, confidential, or sensitive information that you do not want others to know.

Prohibited Conduct

To protect users and the Service, you must not do or attempt to do any of the following:

  1. Use OGAM for illegal, fraudulent, harmful, or abusive purposes.
  2. Create fake accounts, impersonate another person, misrepresent your age, identity, gender, location, relationship, host status, or settlement information.
  3. Share or request sexual exploitation material, child safety violations, non-consensual intimate content, prostitution, trafficking, illegal drugs, gambling, weapons, violence, threats, stalking, harassment, hate, discrimination, scams, or other illegal or harmful content.
  4. Share another person's personal information, contact details, address, identification information, financial information, private photos, screenshots, recordings, or confidential messages without permission.
  5. Record, redistribute, sell, scrape, download, or publish calls, live streams, chats, profiles, or other User Content without proper consent and legal authority.
  6. Request or make off-platform payments, settlement, private contact exchange, external account transfer, or other activity intended to avoid OGAM safety, payment, or moderation systems.
  7. Abuse coins, gifts, VIP, refunds, chargebacks, promotions, referral systems, host settlement, fan club memberships, or event benefits.
  8. Interfere with, reverse engineer, scrape, crawl, overload, attack, bypass, exploit, or disrupt the Service, app, API, database, security system, payment system, moderation system, or third-party infrastructure.
  9. Use bots, scripts, automation, unauthorized clients, emulators, modified apps, account farms, fake traffic, or manipulated devices unless expressly authorized by the Company.
  10. Violate any applicable law, app store rule, platform rule, payment rule, community notice, host rule, or operation policy.
Safety enforcement: The Company may remove content, limit visibility, restrict calls, end live streams, cancel fan club access, freeze coins, withhold settlement, suspend accounts, ban devices, report illegal activity, or take other measures when necessary to protect users and the Service.

Host, Fan Club, Live, and Private Call Rules

Host registration and activity

  1. Host functions may require additional registration, verification, profile review, phone verification, age review, country or language settings, image approval, and Company approval.
  2. Host approval may be granted, rejected, suspended, downgraded, limited, or revoked based on verification results, safety concerns, legal requirements, account history, user reports, policy violations, settlement issues, or service quality.
  3. Hosts must provide accurate profile, media, call rate, settlement, agency, and contact information where requested.
  4. Host earnings, settlement timing, commission, payout minimums, agency allocations, tax handling, and withdrawal availability may follow separate host, agency, settlement, or admin policies.

Fan clubs and live streaming

  1. Fan club rooms, live rooms, chat rooms, memberships, gifts, and related benefits may be operated according to Company policy and may change depending on host level, service availability, safety review, or technical conditions.
  2. The Company may pause, close, remove, hide, or restrict a live room, fan club, chat room, or content if it violates these Terms, applicable law, or safety standards.
  3. Users joining fan clubs or live rooms must respect the host, other fans, and room rules. Abusive chat, spam, harassment, illegal requests, and disruptive behavior may lead to restrictions.

1:1 video calls and live private calls

  1. Private video calls may require available host status, user coin balance, device permissions, network connection, and host acceptance.
  2. During a fan club live, a host may temporarily enter a 1:1 private call. Live viewing behavior may change during that time, and users may see a notice that the host is in a private call.
  3. Per-minute rates, coin charges, free periods, translation fees, and other call-related charges will be shown in the Service where applicable. You are responsible for checking the displayed rate before requesting or accepting a call.
  4. Connection quality may vary due to network, device, platform, or third-party infrastructure. The Company may end or restrict calls for safety, moderation, technical, or payment reasons.

Refunds, Cancellations, and Chargebacks

  1. Purchases made through Apple App Store, Google Play, or another payment platform are generally handled according to that platform's payment, cancellation, and refund rules.
  2. Digital items that have been used, consumed, sent as gifts, spent on calls, spent on paid content, spent on fan club benefits, or otherwise delivered may be non-refundable unless applicable law or platform rules require otherwise.
  3. Refunds may be denied or limited where a user violates these Terms, abuses refunds, receives benefits through fraud, uses payment methods without authorization, manipulates payment records, or is restricted for safety reasons.
  4. If a purchase is refunded, cancelled, charged back, or reversed, the Company may remove the related coins, items, benefits, gifts, VIP access, settlement credit, or content access.
  5. Users must not initiate fraudulent chargebacks. The Company may restrict accounts, recover losses, withhold settlement, or take legal action for fraudulent or abusive payment activity.

Privacy, Safety Review, and Moderation

  1. The Company processes personal information as described in the Privacy Policy. The Privacy Policy explains collection, use, retention, deletion, third-party entrustment, overseas processing, cookies, and user rights.
  2. To protect users, the Company may review reports, profiles, images, videos, paid content, messages, live chats, fan club chats, call metadata, payment records, device information, and service logs through automated systems and human review.
  3. The Company may use translation, AI, abuse detection, App Check, fraud prevention, moderation, and trust and safety systems to detect policy violations and improve service quality.
  4. You must not rely on OGAM as a background check, identity guarantee, safety guarantee, medical service, legal service, or emergency service. Use care when interacting with other users.
  5. If you encounter illegal, harmful, abusive, or suspicious behavior, use report, block, customer support, or other safety tools provided by the Service.

Intellectual Property and Feedback

  1. OGAM, the app, websites, software, source code, databases, designs, UI, trademarks, logos, service names, images, videos, operation systems, ranking systems, recommendation systems, moderation systems, and related materials are owned by the Company or its licensors.
  2. The Company grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for lawful personal use in accordance with these Terms.
  3. You may not copy, modify, distribute, sell, rent, reverse engineer, decompile, extract, scrape, create derivative works from, or commercially exploit any part of OGAM except as expressly permitted by the Company or applicable law.
  4. If you submit ideas, suggestions, bug reports, reviews, or feedback, you grant the Company the right to use them without compensation, restriction, confidentiality obligation, or attribution, unless separately agreed in writing.

Third-Party Services and App Stores

  1. OGAM may use or connect with third-party services such as Firebase, Google, Apple, Google Play, App Store, Agora, Cloudflare, payment platforms, translation services, analytics, push notification services, customer support tools, and hosting providers.
  2. Third-party services may have their own terms, privacy policies, fees, restrictions, and technical requirements. You are responsible for complying with those terms when you use features connected to them.
  3. The Company is not responsible for third-party websites, services, products, app stores, payment processors, carrier charges, external links, advertisements, or user-to-user external transactions unless applicable law states otherwise.
  4. Apple, Google, and other app store operators are not parties to these Terms and may have no obligation to provide support, maintenance, refunds, or claims handling except as required by their own rules or applicable law.

Service Restriction, Suspension, and Termination

Termination by you

  1. You may stop using OGAM at any time. Where the account deletion function is provided, you may request deletion through the app or customer support.
  2. Account deletion may not immediately delete records that must be retained for legal compliance, payment verification, settlement, dispute handling, fraud prevention, safety review, backup, or legitimate business purposes described in the Privacy Policy.

Restriction or termination by the Company

  1. The Company may restrict, suspend, terminate, delete, hide, freeze, withhold, or refuse access to any account, host function, live room, fan club, content, coin, payment, settlement, device, or feature if the Company reasonably believes it is necessary for legal, safety, technical, business, payment, or policy reasons.
  2. Reasons may include violation of these Terms, illegal activity, harmful content, user reports, payment abuse, refund abuse, identity fraud, account sharing, automation, spam, security risk, app store violation, settlement irregularity, or a request from law enforcement or a platform operator.
  3. When an account is terminated or restricted, unused coins, items, gifts, VIP benefits, fan club benefits, host earnings, or settlement amounts may be limited, forfeited, refunded, withheld, or processed according to applicable law, app store rules, and Company policy.

Disclaimers, Liability, and Indemnity

Service provided as available

  1. OGAM is provided on an "as is" and "as available" basis. The Company does not guarantee uninterrupted operation, error-free service, specific matches, host availability, call quality, live quality, income, exposure, ranking, gifts, fan club growth, compatibility, or results.
  2. User Content and user behavior are created by users. The Company does not endorse User Content and is not responsible for every statement, promise, action, or omission of users.
  3. Some jurisdictions do not allow certain limitations or exclusions. In that case, these limitations apply only to the maximum extent permitted by applicable law.

Limitation of liability

  1. To the maximum extent permitted by law, the Company is not liable for indirect, incidental, special, consequential, punitive, reputational, emotional, data, device, business, profit, opportunity, or third-party damages.
  2. If the Company is liable despite these Terms, the Company's liability will be limited to the amount you paid to the Company for the specific paid feature directly related to the claim during the three months before the event, unless applicable law requires a different amount.

Indemnity

You agree to defend, indemnify, and hold harmless the Company, its officers, employees, contractors, affiliates, partners, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from your use of OGAM, your User Content, your violation of these Terms, your violation of law, or your violation of another person's rights.

General Terms

Changes to these Terms

  1. The Company may amend these Terms to reflect changes in law, service features, safety requirements, payment rules, app store rules, business operation, or internal policy.
  2. The Company will notify users of material changes through the app, website, email, push notification, service notice, or other reasonable method before the effective date where required.
  3. If you continue using OGAM after amended Terms become effective, you are deemed to have accepted the amended Terms unless applicable law requires separate consent.

Assignment and severability

  1. You may not transfer or assign your account, rights, or obligations under these Terms without the Company's prior written consent.
  2. The Company may transfer or assign these Terms, the Service, or related rights and obligations in connection with a merger, acquisition, corporate reorganization, asset transfer, outsourcing, or business succession.
  3. If any provision is found invalid or unenforceable, the remaining provisions remain effective, and the invalid provision will be interpreted or replaced to the extent permitted by law to reflect the original purpose.

Governing law and disputes

These Terms are governed by the laws of the Republic of Korea, without regard to conflict of law principles. Disputes will be handled by the competent court under applicable Korean law unless mandatory consumer protection law provides otherwise.

Addendum

  1. These Terms apply from the date of enforcement below and remain effective until amended or replaced.
  2. If these Terms are translated into another language and there is a conflict between versions, the version designated by the Company as controlling will apply to the extent permitted by law.
  3. These Terms are intended for OGAM's current app, host, fan club, live, private call, coin, and web service structure.
